Tax Code by Tommaso Scalici - Terms of Service

Welcome to Tax Code by Tommaso Scalici (the “App”), developed and maintained by Tommaso Scalici (“Developer”, “we”, “us”, or “our”).

By downloading, installing, accessing, or using the App on any platform (including Android and Wear OS), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the App.

1. Important Disclaimer – No Government Affiliation

Tax Code by Tommaso Scalici is an independent third-party software application developed solely by Tommaso Scalici. The App is NOT affiliated with, authorized by, sponsored by, endorsed by, or connected in any way with the Italian Revenue Agency (Agenzia delle Entrate), the Ministry of Economy and Finance (Ministero dell’Economia e delle Finanze), or any other Italian or foreign governmental body or public administration.

The Italian Tax Code (Codice Fiscale) generated by the App is calculated strictly according to the public mathematical algorithm established by Italian Ministerial Decree (D.M. 23/12/1976).

  • The generated code has strictly indicative and informational value.
  • The App does not issue official tax documents and cannot verify cases of homocody (omocodia), which can solely be resolved and officially certified by the Agenzia delle Entrate.
  • The user is solely responsible for ensuring the accuracy of any code before presenting it for official or legal purposes.

2. License and Intellectual Property

Subject to your compliance with these Terms:

  • The developer grants you a personal, worldwide, non-exclusive, non-transferable, revocable license to use the App on your supported devices for personal and professional calculation/storage needs.
  • The open-source components of the code are distributed under the terms of the open-source license published in the GitHub repository (MIT License).
  • All trademarks, logos, visual assets, brand identity (“Tax Code by Tommaso Scalici”), and proprietary UI designs remain the intellectual property of Tommaso Scalici.

3. Acceptable Use and Restrictions

When using the App, you agree not to:

  • Use the App for any fraudulent, unlawful, or deceptive purposes, including identity theft or generating tax codes for fraudulent schemes.
  • Interfere with, disrupt, or attempt to compromise the integrity, security, or availability of the backend infrastructure or Google Cloud / Firebase services powering the App.
  • Attempt to circumvent any authentication mechanisms or access data belonging to other users.
  • Overload or abuse backend API endpoints (including AI document scanning endpoints) through automated scripts or unauthorized automated bots.

4. User Accounts and Cloud Synchronization

  • Guest Mode: You may use all core calculation and local storage features without creating an account or providing authentication credentials.
  • Google Sign-In: If you choose to enable cloud synchronization across multiple devices (Android & Wear OS), you authenticate using Google OAuth 2.0. You are responsible for safeguarding the security and access credentials of your Google Account.
  • Account Termination & Data Removal: You may stop using the cloud synchronization service and delete your account and all associated cloud data at any time via the in-app deletion button (Settings → Delete Account) or by consulting our Data Deletion Instructions.

5. AI Document Scanner Disclaimer

The smart document scanner feature utilizes optical character recognition powered by the Gemini Enterprise Agent Platform (GEAP). While designed for high accuracy:

  • The AI scanner is an assistive tool and may occasionally misread characters due to lighting, reflection, camera quality, or document wear.
  • You are solely responsible for reviewing and verifying the extracted information before saving or using any calculated Tax Code.

6. Disclaimer of Warranties

THE APP AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE COMPLETELY UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT DEFECTS WILL BE IMMEDIATELY CORRECTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOMMASO SCALICI BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF DATA, LOSS OF TIME, ADMINISTRATIVE FINES, OR FINANCIAL LOSSES) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP OR ITS CALCULATED RESULTS.

8. Privacy Policy

Your use of the App is also governed by our Privacy Policy, which explains how your data is collected, stored, and protected in full accordance with the Google API Services User Data Policy and GDPR.

9. Governing Law and Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of Italy and the European Union. Any dispute arising out of or related to these Terms or the App shall be submitted to the competent courts of Italy.
